Whirlwind

These Terms of Service (“Terms”) govern your use of the Whirlwind website at https://whirlwindai.xyz and the Whirlwind product (the “Service”). By purchasing or using the Service, you agree to these Terms.

1. What Whirlwind Is

Whirlwind is a Next.js code template sold as a one-time purchase. You gain access to the source code via a private GitHub repository invitation. The codebase is intended for use as a starting point for your own SaaS or AI product.

2. License Grant

Subject to your payment in full and continued compliance with these Terms, we grant you a non-exclusive, non-transferable license to:

Download, modify, and use the Whirlwind code in your own projects
Build and ship products based on Whirlwind, charge customers for those products, and keep all revenue
Receive ongoing updates to the Whirlwind codebase

The number of projects covered depends on your plan:

BUILD — license to use Whirlwind for one (1) commercial project.
ACCELERATE — license to use Whirlwind for an unlimited number of commercial projects.

3. Restrictions

You may not:

Resell, sublicense, or redistribute the Whirlwind template itself, in whole or in substantial part, as a standalone product or as part of another template, boilerplate, or developer tool
Share your access credentials or GitHub repository access with anyone outside your licensed use
Remove or obscure copyright notices, license terms, or attributions from the source code
Use the Service for any unlawful purpose or in violation of any applicable law or regulation

Products you build using Whirlwind are yours. You retain full ownership of your application code, branding, content, and any modifications you make. You may charge customers for your products without paying us anything beyond your initial purchase.

4. Refund Policy

We offer a 7-day, no-questions-asked refund. To request a refund, email hello@whirlwindai.xyz with your order email address within 7 days of your purchase. We will issue a full refund and revoke your access to the GitHub repository.

Note: while we revoke access to the GitHub repository on refund, we have no technical means to retrieve copies of the code that you have already downloaded or cloned to your own systems. By accepting a refund, you agree to delete all local copies of the Whirlwind source code and discontinue use of any derivative works that incorporate substantial portions of it.

5. Updates and Support

Your purchase includes lifetime access to repository updates pushed to the main branch. We do not guarantee a specific release cadence. Support is provided via email at hello@whirlwindai.xyz. ACCELERATE plan customers receive priority support.

6. Intellectual Property

We retain all intellectual property rights in the Whirlwind template, documentation, and the OpenClaw skill. Your license under Section 2 gives you the right to use these materials but does not transfer ownership.

7. Third-Party Services

Whirlwind integrates with third-party services (Supabase, Stripe, OpenAI, Anthropic, Google, Resend, GitHub, Vercel, etc.) which you may choose to use to power your application. We are not responsible for their availability, terms, pricing, or behavior. Your use of those services is governed by their respective terms.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be error-free, secure, or uninterrupted. You assume full responsibility for any decisions you make based on the Service.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability arising from or related to these Terms or your use of the Service is limited to the amount you paid us in the twelve (12) months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, even if advised of the possibility of such damages.

10. Termination

We may suspend or terminate your access to the Service if you breach these Terms, including by violating the Restrictions in Section 3. Upon termination, your license under Section 2 ends and you must discontinue use of the Service. Sections that by their nature should survive termination (including Sections 3, 6, 8, 9) will survive.

11. Governing Law

These Terms are governed by the laws of Portugal, without regard to conflict-of-laws principles. Any disputes arising from these Terms or your use of the Service will be resolved in the courts of Portimão, Portugal.

12. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated via email. The “Last updated” date at the top reflects the most recent revision. Continued use of the Service after changes constitutes acceptance.
